  1. ARRIVAL AND DEPARTURE

CHECK-IN TIME: 3:00 PM
Early arrivals: Please do not arrive before 3:00 PM unless specifically notified by us.

CHECKOUT TIME: 10:00 AM
Late checkouts without prior arrangement may incur an additional fee equivalent to one night's stay.

  1. BOOKING AND CONTRACT

2.1 When a booking is confirmed with Ar Fasgadh Lodge, a legally binding contract is formed between the property owners ("we," "us," "our") and the person making the booking and all members of their party ("you," "your," "guests").

2.2 This contract is governed by Scottish Law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Scotland.

2.3 The person named on the booking form ("Responsible Person") must:

  • Be at least 18 years of age at the time of booking
  • Stay at the accommodation throughout the holiday
  • Accept full responsibility for ensuring all members of the party adhere to these Terms and Conditions
  • Provide the names, addresses, and ages of all party members upon request

2.4 A contract only arises when:

  • We have received your deposit payment
  • We have confirmed your booking in writing (via email)

2.5 Ar Fasgadh Lodge is to be used solely for the purpose of a holiday accommodation. The Responsible Person must not sub-let the property and must ensure the property is left secure when unoccupied.

 

  1. PAYMENTS AND CANCELLATIONS

3.1 Deposit and Balance:

  • A non-refundable deposit of 35% of the total rental fee is required at the time of booking
  • The remaining balance must be paid in full 4 weeks prior to arrival
  • For bookings made less than 4 weeks before arrival, full payment is required at the time of booking
  • Failure to pay the balance by the due date will be treated as a cancellation

3.2 Cancellation by You:

  • Cancellation prior to final payment: Your deposit will be refunded only if we successfully rebook the property. The refund amount may be reduced if we have to lower the price to secure a replacement booking.
  • Cancellation after final payment: A refund will be provided only if the property can be re-booked. This may not be a full refund if the property is rebooked at a reduced rate.
  • We strongly recommend that you purchase comprehensive travel insurance to cover cancellations.

3.3 Cancellation by Us:

  • In the unlikely event that we need to cancel your booking due to circumstances beyond our control, we will refund all monies paid by you for the booking.
  • Our liability will not extend beyond this refund.
  1. FORCE MAJEURE

4.1 We shall not be liable for any failure or delay in performance of our obligations under this contract that is caused by events outside our reasonable control ("Force Majeure Event").

4.2 Force Majeure Events include but are not limited to:

  • Natural disasters
  • Acts of government or local authority
  • War, riot, civil commotion
  • Epidemic or pandemic
  • Failure of utility services

4.3 If a Force Majeure Event occurs, we will contact you as soon as reasonably possible to notify you. Our obligations under the contract will be suspended for the duration of the Force Majeure Event.

4.4 If a Force Majeure Event occurs and affects your booking, you may choose to:

  • Reschedule your stay for a later date (subject to availability)
  • Accept a credit voucher for a future stay
  • Cancel your booking and receive a refund less any costs already incurred by us that we cannot recover
  1. OCCUPANCY AND CONDUCT

5.1 Maximum Occupancy:

  • The number of people occupying Ar Fasgadh Lodge must not exceed the number stated on your booking form.
  • Exceeding the maximum occupancy without prior written agreement constitutes a breach of contract and may result in immediate termination of your stay without refund.

5.2 Parties and Events:

  • Ar Fasgadh Lodge is not suitable for parties or events.
  • Hosting unauthorized parties or events constitutes a breach of contract and may result in immediate termination of your stay without refund.

5.3 Smoking Policy:

  • A strict no-smoking policy applies inside Ar Fasgadh Lodge.
  • Violation of this policy will result in:
    • Immediate termination of your stay without refund
    • A mandatory cleaning surcharge of £100
  • If smoking outside, please be considerate of neighbours and do not smoke on the deck or near the wooden structure of the lodge.

5.4 Quiet Hours:

  • Quiet hours are from 22:00 to 08:00.
  • Excessive noise at any time, particularly during quiet hours, constitutes a breach of contract and may result in immediate termination of your stay without refund.

 

5.5 Pets:

  • Ar Fasgadh Lodge is strictly pet-free due to allergy concerns.
  • Bringing pets onto the premises constitutes a breach of contract and may result in immediate termination of your stay without refund, plus additional cleaning charges.
  1. PROPERTY CARE AND LIABILITIES

6.1 Damage and Breakages:

  • You are responsible for the property and its contents during your stay.
  • Any damage, breakages, or losses must be reported to us immediately.
  • We reserve the right to charge you for repair, replacement, or additional cleaning costs.

6.2 Cleaning:

  • The property must be left in a reasonably clean and tidy condition upon departure.
  • Excessive cleaning requirements will incur additional charges at a rate of £25 per hour.

6.3 Owner's Access:

  • We reserve the right to enter the property at any reasonable time for essential maintenance or emergencies.
  • We will make every effort to provide advance notice except in cases of emergency.

6.4 Liability Limitation:

  • Our liability for any loss or damage suffered by you or any member of your party shall be limited to the total cost of your booking, except in the case of:
    • Death or personal injury caused by our negligence
    • Fraud or fraudulent misrepresentation
    • Any matter for which it would be illegal for us to exclude or limit our liability

6.5 Personal Belongings:

  • We accept no liability for loss or damage to your personal belongings during your stay.
  • Any items left behind may be forwarded to you at your expense.
  1. FACILITIES AND SERVICES

7.1 Parking:

  • Parking is available for a maximum of 1 car at the lodge.
  • Additional vehicles must be parked in the designated parking area.
  • Commercial vehicles and camper vans are not permitted.

7.2 Electric Vehicle Charging:

  • Electric vehicle charging is not permitted at the property.
  • The nearest charging point is located at the Kinloch Hotel in Blackwaterfoot.
  • Charging EVs through windows or using extension leads is strictly prohibited and constitutes a breach of contract.

7.3 WiFi and Internet:

  • WiFi is provided as a courtesy and its use is subject to our Acceptable Use Policy.
  • We do not guarantee the availability or speed of the WiFi connection.
  • Use of the WiFi for illegal activities is strictly prohibited.
  1. DATA PROTECTION AND PRIVACY

8.1 We collect and process personal information in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

8.2 We will use your personal information only for:

  • Processing your booking
  • Communicating with you about your stay
  • Legal and regulatory compliance

8.3 We will not share your personal information with third parties except where required by law.

  1. GENERAL PROVISIONS

9.1 Accuracy of Information:

  • While we make every effort to ensure the accuracy of our property descriptions and images, we cannot warrant that all details are accurate or complete.
  • We reserve the right to make reasonable modifications to the property and its facilities without notice.

9.2 Complaints:

  • Any problems or complaints must be reported to us immediately, giving us the opportunity to rectify the situation during your stay.
  • Complaints made after departure may not be considered if we were not given the opportunity to address them during your stay.

9.3 Severability:

  • If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9.4 Entire Agreement:

  • These Terms and Conditions constitute the entire agreement between us and supersede any previous discussions, correspondence, negotiations, or agreements.

By making a booking with Ar Fasgadh Lodge, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
